  1. Episode 31: Functional Capacity Evaluations After an Injury from Crashes, Claims & Clarity, opens in a new tab

    Sep 10, 202632 min

What Can You Really Do After an Injury? An MRI or X-ray can show an injury, but it cannot always show how that injury affects someone’s ability to work, care for themselves, or return to everyday life. On this episode of Crashes, Claims & Clarity , Darrell Burrow talks with occupational therapist Peggy Freedman , President of The Freedman Group in Marietta, Georgia. With more than 35 years of experience, Peggy has completed more than 4,000 Functional Capacity Evaluations and over 30,000 treatments. She specializes in evaluating how injuries affect real-world function, from returning to work to managing daily activities safely and independently. Peggy explains what Functional Capacity Evaluations can reveal, why job descriptions do not always reflect the real physical demands of a job, and how hidden injuries can impact recovery long after an accident. 5 Key Takeaways ✅ Medical stability does not always mean functional readiness. A person may be considered medically stable while still having significant difficulty returning to work or handling everyday activities. ✅ Functional Capacity Evaluations look beyond the diagnosis. An MRI or X-ray can identify pathology, but an FCE helps determine what someone can realistically and safely do. ✅ Real job duties may be very different from the written job description. Lifting, reaching, pushing, pulling, and other physical demands are often missing or incomplete on paper. ✅ Some of the most serious limitations may not be obvious. Peggy shares the example of a carpenter whose undiagnosed brain injury affected his ability to perform basic calculations even though his visible injury was healing. ✅ Recovery includes independence and quality of life. Home assessments, job-site evaluations, and practical modifications can help injured individuals return to meaningful activities and function more safely. Peggy also explains the purpose of validity testing, how pain and fatigue are considered during an evaluation, and why objectivity is essential when her findings may affect an injury claim, employment decision, or future treatment. About Peggy Freedman Peggy Freedman is an occupational therapist and President of The Freedman Group in Marietta, Georgia. With more than 35 years of experience, she specializes in Functional Capacity Evaluations, return-to-work programs, work conditioning, home and job-site assessments, and rehabilitation following workplace and personal injuries. She has personally completed more than 4,000 Functional Capacity Evaluations and over 30,000 treatments and is frequently called upon as an expert witness in personal injury, workers’ compensation, and disability cases. 2. Episode 30: What Spine Scans Can Miss After a Crash from Crashes, Claims & Clarity, opens in a new tab

    Sep 3, 202649 min

A patient leaves the emergency room after a crash and is told the imaging looks normal. But days later, the pain is worse, movement is limited, and everyday activities have become difficult. What happens when the scan and the patient’s experience do not match? In this episode of Crashes, Claims & Clarity , Darrell L. Burrow speaks with Dr. Ben Burch, a double board-certified orthopedic spine surgeon at the Atlanta Spine Institute. Dr. Burch explains that emergency room imaging is designed to answer specific questions. A CT scan can provide valuable information about bones and traumatic injuries, but it may not reveal every soft-tissue injury, muscle or ligament strain, or other source of pain. A more obvious injury can also create “distracting pain,” causing a patient to overlook symptoms in another part of the body until later. The conversation also examines one of the most difficult questions following an accident: Did the crash cause a spinal condition, or did it aggravate a condition that was already present? Dr. Burch explains why imaging alone cannot always answer that question. The timing of symptoms, the patient’s history, previous medical records, physical examination, functional limitations, and response to treatment can all help provide a more complete clinical picture. Darrell and Dr. Burch also discuss how physicians determine whether conservative treatment is working, when progress has plateaued, and when surgery may become an appropriate option. Dr. Burch describes his multimodal approach to nonsurgical care, which may include physical therapy, anti-inflammatory treatment, medications directed at nerve or muscle symptoms, and carefully targeted injections. The episode then moves inside the operating room as Dr. Burch explains the difference between uniportal and biportal endoscopic spine surgery. He describes endoscopic surgery as a tool that allows surgeons to reach and treat spinal problems through narrow corridors while attempting to reduce unnecessary damage to surrounding tissue. Listeners will learn: Why a normal CT scan does not necessarily explain persistent pain How distracting pain can hide a secondary injury after a crash Why degenerative changes on an MRI may have existed without symptoms How doctors evaluate whether a crash caused or aggravated a condition Why functional progress may be more useful than a simple pain score How physicians recognize when conservative care has stopped producing progress The difference between uniportal and biportal endoscopic spine surgery Why a small incision does not mean the underlying condition was minor What patients should ask before agreeing to a spine procedure Why AI can assist with measurements but should not replace human clinical judgment Dr. Burch also encourages patients to seek another opinion when appropriate and to ask surgeons direct questions about alternative treatments and their experience performing a recommended procedure. About Dr. Ben Burch Dr. Ben Burch is a double board-certified orthopedic spine surgeon at the Atlanta Spine Institute. He specializes in nonsurgical care and advanced minimally invasive and endoscopic procedures, including both uniportal and biportal techniques. Dr. Burch treats traumatic injuries, herniated discs, spinal stenosis, degenerative conditions, and other complex spinal disorders. He also trains surgeons, contributes to spine research, and performed Georgia’s first endoscopic spinal fusion procedures. 3. Episode 29: Can Your Estate Plan Survive a Crash? from Crashes, Claims & Clarity, opens in a new tab

    Aug 27, 202633 min

Can your estate plan survive a crash? A serious accident can test far more than your insurance coverage. It can expose outdated documents, incorrectly titled assets, missing decision-making authority, and family members who have no idea what to do next. In this episode of Crashes, Claims & Clarity, Darrell Burrow speaks with estate planning and elder law attorney Mike Bascom about whether an estate plan will actually work when a family needs it most. Mike explains why an effective estate plan must be written, current, and appropriate for the state where someone lives. He also discusses how beneficiary designations and asset ownership can override the instructions in a will or trust. Darrell and Mike explore what someone should consider after receiving a significant injury settlement, why a spouse may not automatically have the authority to operate a family business, and what can happen to rental properties when an owner becomes incapacitated. They also discuss preparing the professionals, family members, and trusted individuals who will eventually carry out the plan. Without clear instructions and access to the necessary information, an unexpected crisis can quickly become an expensive and emotional treasure hunt. In this episode, you will learn: Why an estate plan should be reviewed after major life changes How beneficiary designations and asset ownership can undermine a plan What to consider before spending or investing an injury settlement Why business owners need an incapacity and succession plan How to prepare the people responsible for carrying out your wishes What veterans and their spouses may overlook when long-term care is needed Why owning property in multiple states can create additional complications Why fair treatment among beneficiaries does not always mean equal treatment An estate plan should not simply exist. It should protect your family, property, income, and business when the unexpected happens. Connect with Mike Bascom and learn more about Bascom Law at BascomLaw.com . 4. Episode 28: PTSD After a Car Accident: Signs You Shouldn’t Ignore from Crashes, Claims & Clarity, opens in a new tab

    Aug 13, 202615 min

A car accident can leave injuries that don't show up on an X-ray. On this episode of Crashes, Claims & Clarity , Georgia personal injury attorney Darrell Burrow sits down with Dr. J. Todd George, Psy.D., licensed clinical psychologist and evaluation specialist with Atlanta Psychological Services , to discuss the psychological impact that can follow a serious crash or traumatic injury. Dr. George explains that motor vehicle accidents are a significant cause of post-traumatic stress disorder and that symptoms aren't always immediate. Survivors may experience nightmares, heightened anxiety, avoidance of driving, changes in sleep, irritability, withdrawal, or repeatedly replaying the accident in their minds. They also discuss why children can show trauma very differently from adults. Rather than talking about their feelings, children may regress in previously mastered skills or repeatedly reenact the accident through play. Perhaps most importantly, Dr. George explains when normal stress following an accident may have crossed the line into something that deserves professional evaluation. In this episode, you'll learn: Why psychological injuries after car accidents are more common than many people realize Early warning signs of trauma, including nightmares, hyperarousal, avoidance, and withdrawal Why fear of driving after an accident can persist The general one-month benchmark Dr. George uses when considering psychological evaluation How PTSD and severe anxiety may affect pain and physical recovery Why emotional symptoms can appear weeks after the original accident How children may communicate trauma through behavioral regression or repetitive play What family members can do to support someone recovering from trauma Why using drugs or alcohol to numb anxiety is a warning sign that deserves faster attention Practical strategies for recovery, including sleep and gradual re-exposure when medically appropriate Dr. George leaves listeners with an important reminder: psychological injuries are just as real as physical injuries and deserve appropriate professional care. Connect with Dr. J. Todd George If you or a family member is experiencing ongoing anxiety, changes in behavior, difficulty driving, nightmares, or other emotional concerns following a traumatic event, consider speaking with a qualified mental health professional. Dr. J. Todd George, Psy.D. is a licensed clinical psychologist and evaluation specialist with Atlanta Psychological Services , providing comprehensive psychological evaluations for children, adolescents, and adults. To learn more about Dr. George and Atlanta Psychological Services, visit: Atlanta Psychological Services And remember: psychological injuries deserve attention and appropriate care just as physical injuries do, a central message Dr. George shares in this episode.

  6. Bonus: Teen Driving Safety Tips Every Parent Should Know from Crashes, Claims & Clarity, opens in a new tab

    Jul 30, 20269 min

Handing a teenager the car keys means more than giving them freedom. It means preparing them for the responsibility and consequences that come with driving. In this solo episode of Crashes, Claims & Clarity , Georgia attorney Darrell Burrow shares the essential conversations parents should have with teen drivers before they begin driving alone. Drawing on more than 30 years of experience handling automobile accidents, Darrell explains how parents can help teenagers recognize hazards, avoid distractions, understand insurance, and respond appropriately after a crash. 5 Key Takeaways → Teach teen drivers to look farther down the road instead of focusing only on the vehicle directly ahead → Help them understand how distraction from phones, music, friends, and passengers can change a life in seconds → Explain automobile insurance, including liability, collision, comprehensive, and uninsured motorist coverage → Contact your insurance carrier when your teenager becomes licensed to ensure they are properly listed and covered → Make sure your teenager knows to remain at the scene, call 911, request medical assistance when needed, take photographs, and provide only an accurate account of what happened A driver’s license provides freedom, but it also carries serious responsibility. 11. Episode 25: Why Minor Accidents Can Cause Major Injuries from Crashes, Claims & Clarity, opens in a new tab

    Jun 25, 202627 min

Many people walk away from a car accident believing they are fine, only to develop pain, stiffness, headaches, or other symptoms days later. In this episode, Darrell Burrow sits down with chiropractor Jay Lerner of Southern Crescent Clinic to discuss why so-called "minor" accidents can still cause significant injuries and why early evaluation matters. Jay explains how adrenaline can mask pain, why inflammation plays a major role in recovery, and how modern lifestyles may make people more vulnerable to injury. He also shares common mistakes people make after a crash, the difference between being pain-free and truly healed, and practical steps anyone can take to support recovery and protect their long-term health. Key Takeaways Vehicle damage does not determine the severity of a person's injuries. Adrenaline can delay symptoms for hours or even days after an accident. Remaining completely inactive after a crash can slow recovery. Hydration, proper movement, and reducing inflammation are critical during healing. Being pain-free does not necessarily mean the body has fully recovered. Recovery after an accident is about more than waiting for pain to disappear. As Jay Lerner explains, early evaluation, proper treatment, and staying active can make a significant difference in long-term outcomes. Even when an accident seems minor, listening to your body and addressing symptoms early may help prevent chronic issues down the road. 16. Episode 21: Pain Free Does Not Mean Fully Recovered from Crashes, Claims & Clarity, opens in a new tab

    May 21, 202628 min

The Dangerous Gap Between Feeling Better and Being Better In this episode of Crashes, Claims & Clarity , attorney Darrell Burrow sits down with Gage Winkels , Doctor of Chiropractic at Health-Fit Chiropractic & Sports Recovery , to unpack one of the biggest mistakes injured patients make… assuming less pain means full recovery. Dr. Winkels explains why pain is only one piece of the recovery puzzle. Whether someone has been in a car accident, suffered a sports injury, or is simply trying to get back to normal daily life, true healing requires more than symptom relief. It requires function, movement, strength, stability, and a clinician who knows what to look for. 19. Episode 18: Why Physical Therapy Matters Early from Crashes, Claims & Clarity, opens in a new tab

    Apr 30, 202629 min

Most people assume that if they walk away from an accident, the worst is over. That is not always true. In this episode, Darrell Burrow sits down with Joseph H. Kostuch of HPRC Physical Therapy to talk about what injury recovery actually looks like after a workplace accident or motor vehicle crash. Joe shares why the first few days can be misleading, how physical therapists help identify what is normal soreness versus something more serious, and why movement, consistency, and documentation all play a major role in recovery. He also explains Georgia’s direct access window for physical therapy and why early care can help prevent bigger issues later. → Why symptoms often change in the first days and weeks after an accident → What physical therapists look for when evaluating a new injury patient → How early therapy can help prevent secondary problems and delayed recovery → Why home exercises and simple movement matter more than people think → Why patients should not stop treatment just because they start feeling better → How outcomes and progress are measured over time during recovery Listen to Crashes, Claims & Clarity : https://podcasts.apple.com/us/podcast/crashes-claims-clarity/id1824256144 Get in touch with guest Joseph H. 20. Episode 17: Workers Compensation Mistakes That Cost You Your Case from Crashes, Claims & Clarity, opens in a new tab

    Apr 23, 202627 min

Most people think workers compensation is there to protect them. Until they actually need it. If you get hurt at work, the clock starts immediately. What you report, what you do not report, who sends you for treatment, and how fast your employer responds can all shape what happens next. In this episode of Crashes, Claims & Clarity, attorney Darrell Burrow sits down with longtime Georgia attorney Tom Holder, who has represented injured workers since 1984. Tom has spent more than four decades helping people understand their rights, avoid costly mistakes, and navigate a system that can feel confusing, slow, and stacked against them. He also brings a broader perspective through his leadership in workers compensation law and his work as a certified mediator. This conversation gets into the real problems injured workers face after an accident on the job. Not the polished version. The real one. Delayed reporting. Delayed treatment. Employers who do not move the process forward. Doctors who say someone is ready to go back when they know they are not. Confusion between workers compensation and personal injury. And the hard truth that one bad move early on can create problems that follow a case for months or years. Tom explains why reporting the injury immediately matters, what workers' compensation actually covers, why medical care is often the biggest battle, and how quickly an injured worker can feel like everyone in the process works for the company except them. He also shares what happens to families when a serious work injury changes income, health, and daily life simultaneously. If you have ever wondered what to do after a workplace injury or whether something about your claim feels off, this episode is worth your time. In this episode → Why waiting to report a workplace injury can seriously damage a claim → What workers' compensation covers and what it does not → How workers' comp differs from personal injury → Why medical treatment delays are such a major issue → What happens when an injured worker is pushed back to work too soon → Why talking to an attorney early can save people from avoidable mistakes Connect with Tom Holder Gerber and Elkins 678.802.8650 Connect with Darrell Burrow https://legalatlanta.com/ Listen and share If you know someone who works on job sites, in warehouses, in healthcare, in transportation, or anywhere injuries happen fast and confusion follows faster, send them this episode.
